IWPL has been performing their act and running the show entitled "Faulty Towers The Dining Experience" since 1997. IWPL launched "Faulty Towers The Dining Experience" in Europe at the Edinburgh Festival 2008. Since then IWPL's show has gained national and international exposure based on a substantive PR campaign managed from Europe, which has considerably raised it's profile. It wins 5-star critical and public acclaim globally.
"Faulty Towers The Dining Experience" is a tribute show. Whilst the show features the three principal protagonists from Fawlty Towers (which in and of themselves do not attract copyright protection), it does not reproduce the scripts from the original series. There is a scripted element to our show (which we have written and is original) but the majority of our show is improvised. Our show (including our scripts) therefore attracts its own copyright protection (© 1997-2019 Interactive Theatre Australia and Interactive Theatre International). IWPL and FTTDE will take legal action against any company or individual using scripts or content for "Faulty Towers The Dining Experience" the copyright in which is owned by IWPL, Interactive Theatre Australia, Interactive Theatre International, Faulty Towers The Dining Experience Ltd, The Faulty Towers Experience Limited and/or Alison Pollard-Mansergh.
"Faulty Towers The Dining Experience" attracts substantial goodwill and reputation which we wish to protect. IWPL and FTTDE Ltd have successfully taken and will continue to take legal action against third parties who pass themselves off as being IWPL/FTTDE Ltd/"Faulty Towers The Dining Experience" or in some way endorsed by us. Competitors should undertake not to in any way shape or form give the impression or otherwise suggest that they are in any way related to IWPL or FTTDE.
What is 'passing off'?
Passing off is a common law action and is used to prevent one party from using the goodwill associated with another party for their own benefit. This does not provide a monopoly right over the mark; instead it protects the owner of the goodwill against what can be referred to as ‘unfair competition’. The law of passing off is extensive and covers the goodwill associated with a trademark, signs, visual images, domain names, business names, show names, and other descriptive material.
